Terms and Conditions

These are the terms and conditions which apply to your Visions Holiday Group Limited holiday. Please read them carefully as you will be bound them.
Security

Your contract is with Visions Holiday Group Limited which is fully bonded by the UK Civil Aviation Authority under Air Travel Organisers Licence (ATOL) No. 5889. Holiday vacations that include return flights commencing and returning to the UK only are financially protected by the ATOL scheme. When you pay you will be supplied with an ATOL Certificate. Please ask for it and check to ensure that it is correct. This ATOL Certificate must be taken with you, along with all other important documentation (passport, confirmation invoice, flight e-tickets, accommodation & transfer vouchers etc) when you travel so please ensure that you keep this in a secure and safe place. As the ATOL scheme only covers holiday vacations that include return flights commencing in and returning to the UK only, ground arrangement only holiday vacation packages are not covered by the ATOL scheme.

Ground arrangement only holidays and accommodation only arrangements are financially protected by the Association of Bonded Travel Organisers Trust Limited (ABTOT membership number 5217).

The Association of Bonded Travel Organisers Trust Limited (ABTOT) provides financial protection under The Package Travel and Linked Travel Arrangements Regulations 2018 for Visions Holiday Group, and in the event of their insolvency, protection is provided for the following:

1. non-flight packages and

2. flight inclusive packages that commence outside of the EU, which are sold to customers outside of the EU.

ABTOT cover provides for a refund in the event you have not yet travelled or repatriation if you are abroad. Please note that bookings made outside the EU are only protected by ABTOT when purchased directly with Visions Holiday Group.

In the unlikely event that you require assistance whilst abroad due to our financial failure, please call the ABTOT 24/7 helpline on 01702 811397 and advise you are a customer of an ABTOT protected travel company.

1) Your contract with us

All products in this brochure are sold subject to the following booking terms and conditions, which comply with the Tour Operators’ Code of Conduct issued by ABTA – the Travel Association in association with the Office of Fair Trading. When you book a holiday with us the contract comes into effect when you or your chosen agent asks us to confirm your booking. We then become responsible to provide you with the holiday and you become responsible to pay for it, in each case subject to these terms and conditions.

It is important that you check the written confirmation when you receive it. If booking within 2 weeks of departure that all details are as you require them within 24 hours. If you wish to change or cancel any arrangements later you may have to pay an amendment or cancellation charge and additional costs (see 6 below) which may be as much as the whole of the original price of your arrangements. When you make a booking you guarantee that you have the authority to accept on behalf of your party the terms of these booking conditions and accept responsibility for making all payments to us for all members of the party. We will send all documents to you or your chosen travel agent and you will be responsible for ensuring that all other members of your party are kept fully informed. No verbal amendments may be made by either party to these written booking conditions. Any amendments to your booking must be received in writing. If you book through an agent all communication must be through that agent. All money which you pay to the agent before we have sent confirmation of your booking will be held by the travel agent on our behalf.

Your contract with Visions Holiday Group Ltd. is made once you have paid the relevant deposit (non-refundable) per person and our confirmation invoice has been issued.

2. Booking your holiday

If you book directly with Visions Holiday Group Limited, all correspondence will be sent to the address specified at the time of booking. If the booking is made through a travel agent, all communications by Visions Holiday Group Limited will be to the travel agent. All monies that you pay to the travel agent will be held by them as an agent for Visions Holiday Group Limited. Visions Holiday Group Limited reserves the right to refuse or accept a booking at its discretion.

3. The payment details

A deposit of £200 (US$300) per person for South Africa itineraries or 20% of the booking value for all other areas and must be settled at the time of booking. In some circumstances, a higher deposit will be requested to reflect the booking policy of an individual property and/or airline. All deposit amounts are non-refundable.

For all new bookings taken from 13 January 2018, Visions Holiday Group will be accepting credit card payments up to the total value of £1500.00 per booking reference, this will incur no extra fees. The remaining balance if applicable will need to be settled by debit card or by BACS payment.

The balance of your booking payment must be received by Visions Holiday Group Limited at least 12 weeks prior to the date of departure (for bookings confirmed after 01 July 2021). Your travel documents will not be released until the balance of payment has been received by Visions Holiday Group Limited. In the case of bookings made less than 12 weeks prior to departure, full payment is due immediately. If the final payment is not received by the due date, Visions Holiday Group Limited reserves the right to cancel the booking and to apply the charges as set out in paragraph 6 below.

4. Price guarantee

The price of your travel arrangements is subject to surcharges on the following items: for increases in transportation cost such as fuel, scheduled are fares, and any other airline surcharges which are part of the contract between airlines (and their agents) and the tour operator or travel organiser, Government action such as increases in VAT or any other imposed increases, and currency changes in relation to adverse exchange variations, Even in these cases we will absorb an amount equal to 2% of the holiday price which excludes insurance premiums and any other amendment charges. only amounts in excess of this 2% will be surcharged and no surcharge will apply within 20 days prior to your departure. If this totals more than 8% of the holiday price you will be entitled to cancel your holiday with a full refund of all monies paid except for any amendment charges. Should you decide to cancel because of this you must excercise your right to do so within 14 days from the issue date of the the surcharge invoice. Should the price of your holiday go down due to the changes mentioned then any refund due will be paid to you. All prices on this website apply at the time of publication, but we reserve the right to increase of decrease any of those prices at any time.

5. Airport charges and departure taxes

Action by UK governments and other authorities introducing mandatory increases or new charges are not covered by Visions Holiday Group Limited’s price guarantee. All known pre-payable charges are included in the prices shown on this website. However, certain taxes can only be paid locally, and it is your responsibility to ensure that you have sufficient local currency to pay these taxes.

6. Cancellation by you

If you wish to cancel your booking, you must notify Visions Holiday Group Limited in writing. The date of cancellation will be the date that we receive this written notice. In the event of cancellation by you, no insurance premiums paid will be refunded and the following cancellation charges will apply:-

7. Alterations by you

If you wish to change your booking after our confirmation invoice has been issued, you must inform Visions Holiday Group Limited in writing, and we will do our utmost to meet your request but it may not always be possible to do so. An administration charge of £40 (US$60) per alteration per booking will apply together with any further costs that we may incur. Amendments cannot be made less than 56 days prior to departure and would be treated as a cancellation. Please note in some instances airlines require full payment of the air fare at the time of booking and charge 100% of the air fare in the event of cancellation. You will be advised of such conditions at the time of booking. Requests for an amendment or cancellation to a booking must be made in writing to Visions Holiday Group Limited and we will confirm our acceptance by issuing the appropriate confirmation/invoice. If you amend your travel arrangements after your holiday has commenced, it is your responsibility to meet any additional costs that may be incurred and, we regret that no refunds are due for any unused services.

8. Cancellation by Visions Holiday Group Limited

Visions Holiday Group Limited will not cancel your booking after the balance due date unless it has to as a result of any of the reasons referred to in paragraph 13 below, or unless payment has not been received by Visions Holiday Group Limited in accordance with the payment conditions in paragraph 3. Subject to the above, Visions Holiday Group Limited reserves the right to cancel your booking on or before the date when payment of the balance of your booking becomes due. In the event of cancellation by Visions Holiday Group Limited, we will inform you or your travel agent as soon as reasonably possible and you will be offered the choice of an alternative of comparable standard if available, together with a full refund of any price differential, or a full refund of monies you have paid. Visions Holiday Group Limited reserves the right at our absolute discretion to terminate without notice the booking of any client whose behaviour is such that it is likely, in Visions Holiday Group Limited’s opinion, or the opinion of an airline pilot or other person in authority, to cause distress, damage, danger or annoyance to other clients, employees, any third party or property. In the event of termination of your holiday due to any of the circumstances in this sub paragraph, our responsibility ceases. Full cancellation charges will apply and Visions Holiday Group Limited will be under no obligation to refund, compensate or indemnify you for any other costs you may incur.

9. Alterations by Visions Holiday Group Limited

It is unlikely that Visions Holiday Group Limited will have to make any changes to your booking, but in the event of minor changes having to be made, we reserve the right to do so. Should it be necessary for a material change to your booking (which we reserve the right to do), Visions Holiday Group Limited will inform you or your travel agent as soon as reasonably possible. A material change is one that is made to your booking before departure that involves, for example, a change of flight time by more than twelve hours or a change of airport (except where they serve the same city or resort), or a change to a lower standard of accommodation. In the event of a material change, you will be offered the choice of:-

(i) accepting the alteration and the contract being varied accordingly;

(ii) purchasing an alternative with Visions Holiday Group Limited with a credit being given for the price of the original arrangement;

or

(iii) a refund of any money you have paid.

Any alteration to the airlines or aircraft types set out in this brochure or otherwise notified to you will not entitle you to cancel your booking or to receive compensation. Where flight timings have been given, these are for information only.

10. Compensation for cancellation or major alteration by Visions Holiday Group Limited

In the event of cancellation or a major alteration to your booking, Visions Holiday Group Limited will pay you compensation as follows (except where we have to cancel or make a major change to your holiday as a result of any of the reasons referred to in paragraphs 3 or 13 whereby compensation is not payable)

No other claims for compensation or expenses will be considered. Land only bookings do not qualify for any compensation.

11. Visions Holiday Group Limited’s liability

(i) Although Visions Holiday Group Limited has no direct control over the services provided to you by independent suppliers, it does accept responsibility for the quality of your holiday components.

(ii) Visions Holiday Group Limited also accepts responsibility if you or any person named on the booking form suffers bodily injury, illness or death due to a negligent act and/or omission of:-

(a) our employees or agents; or

(b) our suppliers or sub-contractors’ servants or agents whilst they are acting in the course of their employment to provide any service or arrangement forming part of the holiday that you have booked with us. Our liability is limited to the full extent allowed by relevant international conventions in respect of anything arising during or out of carriage by air, land or sea to which such international conventions apply; provided that any such claims are notified in writing to Visions Holiday Group Limited within ninety days of completion of such carriage and any claims will be subject to and dealt with in accordance with English law and will be subject to the exclusive jurisdiction of the courts of England and Wales. Visions Holiday Group Limited’s liability to you (except in the case of damages for personal injury or death), is limited to twice the price of the holiday paid by you or the affected member of your party.

(iii) Should you or any member of your party suffer illness, personal injury or death, through any misadventure out of an activity, which does not form part of our travel arrangements, nor part of an excursion sold through us, we shall, at our discretion, offer advice and assistance. This may include initial financial assistance in the form of a Legal Expenses Insurance, where appropriate, up to a limit of £5,000 per booking. All requests for assistance must be made within ninety days of the misadventure and you must receive our written consent prior to commencement of legal proceedings. Our consent will be given subject to you undertaking to assign to Visions Holiday Group Limited any costs or benefits received from any judgement or insurance payment that you may obtain.

12. Conditions of carriage

All transportation by air or land is subject to the contractual terms and conditions of carriage of the company providing the transport, some of which may limit or exclude liability. Carriers’ terms and conditions are subject to International Conventions, namely the Warsaw, Athens, Geneva and Paris Conventions, copies of which are available for inspection at our registered office. By its contract with you, Visions Holiday Group Limited does not enter into an agreement for carriage by air or land, but only undertakes to reserve on your behalf accommodation on board an aircraft or vehicle operated by an airline or ground service selected by Visions Holiday Group Limited.

13. Force Majeure

Visions Holiday Group Limited accepts no responsibility for and shall not be liable in respect of any loss or damage or alterations, delays or changes arising from unusual and unforeseeable circumstances beyond its control, such as war or threat of war, riot, civil strife, industrial dispute including air traffic control disputes, terrorist activity, natural or nuclear disaster, fire or adverse weather conditions, technical problems with transport, closure or congestion of airport or ports, nor cancellation of schedules by airlines.

14. Consumer protection

Your contract is with Visions Holiday Group Ltd. which is fully bonded by the UK Civil Aviation Authority under Air Travel Organisers Licence (ATOL) No. 5889. Holiday vacations that include return flights commencing and returning to the UK only are financially protected by the ATOL scheme. Ground arrangement only holiday vacation packages and accommodation only arrangements are financially protected by the Association of Bonded Travel Organisers Trust Limited ( ABTOT). Visions Holiday Group Ltd. – Visions Travel Group has provided a bond to meet the requirements of the Package Travel, Package Holidays and Package Tours regulations 1992. In the unlikely event of Visions Holiday Group Ltd. insolvency, protection is provided for non-flight packages commencing in and returning to the UK and other non-flight packages excluding the pre-arranged travel to and from your destination.

15. Complaints Procedure

If you have a problem during your holiday, please inform the relevant authority (e.g. hotel, tour manager, etc.) immediately who will endeavour to resolve it. If your complaint is not resolved locally, you must follow this up within 28 days of your return home by writing to our Customer Services Department, Bolney Place, Cowfold Road, Bolney, Haywards Heath, West Sussex, United Kingdom, RH17 5QT, giving all the relevant information. Please note that it is a condition of this contract that you communicate any problem locally whilst on holiday. If you fail to follow this simple procedure we cannot accept responsibility as we will have been deprived of the opportunity to investigate and rectify the problem and this may affect your rights under this contract. No action can be taken nor liability accepted for complaints received by Visions Holiday Group Limited more than 28 days after completion of your holiday. Disputes arising out of, or in connection with this contract, which cannot be amicably settled may be referred to Arbitration, if the customer so wishes, under a special scheme arranged by ABTA – the Travel Association and administered independently by the Chartered Institute of Arbitrators. The scheme provides for a simple and inexpensive method of Arbitration on documents alone with restricted liability on the customer in respect of costs. The scheme does not apply to claims greater than £5,000 per person or £25,000 per booking form. Also it does not apply to claims, which relate to physical injury or illness or the consequences of such injury or illness. 16. Jurisdiction

This contract is governed by English law and subject to the provisions of paragraph 15 above concerning your right to go to arbitration if you so choose, any dispute arising here under shall be subject to the exclusive jurisdiction of the Courts of England and Wales.

17. Brochure validity and accuracy changes and errors

The information on this website and within the brochure may have changed by the time you book your holiday. We do make every effort to ensure accuracy at the time of printing but regrettably errors do occur. Please ensure that you check all details of your holiday (including price) are correct at the time of booking and on receipt of your confirmation invoice. .Where maps and distances are shown on this website, these are only intended as a general guide for you.

18. Health and Safety

Whilst Visions Holiday Group Limited make every effort to use the services of reputable suppliers, it is important to remember that overseas safety standards and regulations are the responsibility of the governing authorities of each country and as a result may differ from those in the UK. .You are therefore requested to take extra care when venturing into unfamiliar buildings and surroundings. .We would respectfully request that you take a few minutes to familiarise yourselves with the fire escape routes and take sensible precautions with regards to local foods and beverages, in particular, ice in drinks. If you are doing a safari please follow the instructions and advice of your guide at all times, please keep with your party and never walk alone

19) Data Protection

In order to process your booking and to ensure that your travel arrangements run smoothly, Visions Holiday Group Limited need to use the information that you provide such as name, address, passport details, any special needs, dietary requirements etc. and pass this information on to the relevant suppliers of your travel arrangements such as airlines, hotels, transportation companies, travel agent etc. We take full responsibility for ensuring that proper security measures are in place to protect your information. The information may also be provided to security or credit checking companies, public authorities such as customs/immigration if required by them, or if required by law. You should be aware that controls on data protection in other countries, particularly those outside of the EEA (Economic Union Area), may not be  a strong as those in this country. Visions Holiday Group Limited will not pass any information to any person not responsible for your travel arrangements. This applies to sensitive information that you give to us such as details of any disabilities or dietary requirements. (If we cannot pass this information to the relevant suppliers we cannot process your booking. In making this booking you consent to this information being passed to the relevant persons. Please note that where information is also held by your chosen travel agent, this is subject to your agent’s own data protection policy.
